Broken Chalk is responsible for the processing of your personal data. This privacy policy applies only to the information collected and processed by Broken Chalk. We do not have a Data Protection Officer, but we are happy to help you with your questions. For this you can contact our Legal department. What types of Data are Collected from you?

Personal Data:

We may collect personal information from you when you visit our website, make a donation, or interact with us. This may include:

  • Your name, address, telephone number, email address, and date of birth.

  • Financial information you provide to us, such as account number.

  • Information you enter into our website.

  • Information about your donation history and correspondence with us.

  • Photos or videos when you participate in an event of ours.

  • Technical information and data visit to our website, such as your IP address and the type and version of your internet browser.

Other communications with us, including mentions of reasons of your incredible support to our cause.

Use of your Personal Data:

Broken Chalk may use your Personal Data for the following purposes:

  • To communicate with you about your donations and other activities.

  • For the processing of your donations and to provide receipts.

  • To improve our website and services.

  • To comply with legal obligations.

  • To communicate with you and facilitate social sharing functionality.

  • To provide the services or information you have requested, for example when you request to be part of Broken Chalk’s newsletter.

Sometimes we ask for your date of birth. We do this to make the communication as relevant as possible and to check whether any authorization for a donation is issued by an adult.

Particular cases of Personal Data collection:

We collect more data for certain types of campaigns or promotions:

• Periodic donation: If you enter into a periodic donation agreement with us, we will ask you for your full name, e-mail address and payment information (such as 

credit card information), to be able to process your donation through the payment platform we are using.

• Audio and video fragments: For some campaigns or actions we may ask you to record an audio or video fragment. We always do this based on your consent. These fragments are only used for the purpose for which they were collected. It is also possible that we use them for an internal compilation.

Sharing Personal Data:

We do not sell, share, trade, or rent your personal data for third-party marketing purposes. We may provide personal information securely to suppliers who perform services for us on our behalf to support our business processes (for example, processing a payment or sending our newsletter). In all cases, we do not grant these organisations any right to use your personal information for anything other than to provide services to us and to do so in accordance with our instructions.

When we engage external companies to collect or process personal data for us, we perform extensive checks on these companies before we start working with them. An example of external companies we may work with are mail order houses and social media service providers.

In order to provide our services at Broken Chalk we may provide your personal data to parties established outside the European Economic Area (EEA). Broken Chalk will only do this if there is an appropriate level of protection for the processing of personal data. This means, for example, if we use a model agreement from the European Commission or make agreements about the handling of personal data.

Retention of Your Personal Data:

Broken Chalk retains your personal data for a period of 11 months, unless a longer retention period is required by law for specific categories of data, such as the data provided when you donate to our Stitching. We assure that your data is not kept longer than necessary, adhering to the GDPR.

Protection of Your Personal Data:

The protection of data and privacy is of utmost importance for us at Broken Chalk. We comply with data protection laws, including the General Data Protection Regulation (GDPR) and any other applicable Dutch Act or Regulation regarding the processing of personal data, or the protection of privacy.

We have taken adequate security measures to prevent your personal data from being lost, used or accessed unlawfully. We hope that nothing will ever go wrong, but if this is the case, we have a procedure in place that states how to deal with a (potential) data leak. If it concerns your personal data, we will inform you immediately.

What is our legal basis for data processing?

All our use of personal data is in accordance with the law. The General Data Protection Regulation (GDPR) requires that we only process data if we have a legal basis for doing so, which are:

  • Consent: We collect, process and store your personal data in cases where you have given consent.

  • Contractual obligation: We collect, process and store your personal data to execute contracts, such as providing a requested service.

  • Legitimate interest: We collect, process and store your personal data when it is necessary for us and does not affect your privacy.

To comply with legal or regulatory obligations under EU law or Dutch National Laws.

What are your rights?

Under the General Data Protection Regulation (GDPR), you have the following rights regarding the collected data:

  • Right to access your data: You have the right to request details about the data we have collected about you. General information can also always be found in this privacy statement.

  • Right to rectification: If your personal data is incorrect or incomplete, you have the right to have your personal data rectified or supplemented.

  • Right to restriction of processing: You can have us restrict the processing of your personal data, for example during the period in which we are checking your request to rectify your personal data.

  • Right to erasure of personal data (‘right to be forgotten’): You have the right to have your personal data erased by us, unless we have permitted reasons under the GDPR to retain your personal data. It may happen that we are unable to erase your data because Tax Authorities require us to retain financial agreements for certain period of time. If you request erasure because you no longer wish to be approached for marketing campaigns, we must remember your name in order to be able to exclude you from our future campaigns.
  • Right to object: You also have the right to object to the processing of your personal data by us. In doing so, we may ask you which specific situation the objection concerns. This objection will be recorded in our database.

Communication with you:

If you support Broken Chalk with a donation, paid action or volunteer work, you have a customer relationship with us. We can contact you by e-mail or telephone if you leave your e-mail address or telephone number with us, based on prior consent obtained from you and legitimate interest of Broken Chalk. We always give you the opportunity to indicate in advance that you do not want to receive e-mail or telephone; we call this the right to object. If you later change your mind and do not want to receive e-mail or telephone, you can always indicate this to us. We only use the data you provide to us. If you do not have a customer relationship with us, we will first ask your permission to contact you by email or telephone. If we need to contact you for service reasons, for example to confirm a donation, your consent is not required.

Below are some of the topics we communicate about that relate to our work for the right to education:

  • Fundraising: Your financial support is essential to our work and without you we would not be able to raise awareness regarding infringements of the right to education, as well as monitor education in countries around the world. We may ask you to make a financial contribution, or to adjust the way you support us.

  • Campaigns: We would like to inform you about our campaign activities so that you can participate by, for example, signing a petition or sharing our social media posts.

Events: We would like to involve you or invite you to our events. 

Changes to this Privacy Policy

We may update Our Privacy Policy from time to time to reflect changes in Data Protection regulations or other legislations. We will notify you of any changes by posting the new Privacy Policy on this page. We will let you know via email and/or update the “Last updated” date at the top of this Privacy Policy. 

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
