Press Release: Lawyers Detained in Turkey Urgent Action Request from all Human Rights Defenders

President of the European Court of Human Rights Spano visited Turkey in the first days of September. Human Rights Defenders have a great expectation from this visit; unfortunately, it was a great disappointment. Few days after his visit, 11 September 2020, Forty-eight lawyers, seven intern lawyers, four dismissed judges, and one law school graduate are arrested based on which clients they represent.1

 

The report, which is published by Arrested Lawyers Initiative in August 2020, stated that;

 

“According to the latest version of the report, since 2016’s coup attempt, more than 1500 lawyers have been prosecuted and 605 lawyers arrested (remanded to pretrial detention). So far, 441 lawyers have been sentenced to a total of 2728 years in prison on the grounds of membership of an armed terrorist organization or of spreading terrorist propaganda.”2

 

Following statement said by Turkish President Erdogan on his speech during the opening new legal year for 2020.

 

“If people who work in other institutions can be dismissed from their profession for supporting terrorism, I think the possible necessity of such a move for the lawyers should also be discussed,”3

 

With his speech openly, Erdogan targeted the Lawyers who are defending the oppositions. Only a week after President Erdogan’s speech, 60 Lawyers were arrested.

 

Lawyers are the only legal people who can defend the people who are facing Human Rights Violations. In today’s Turkey, it is not easy for a jailed opposition to get a lawyer who will protect their fundamental Human rights. The persecution of lawyers facilitates torture and ill-treatment of detained persons and prevent them from asking that their fundamental human rights are respected.

 

Please do not remain silent against this unlawfulness.

 

We are requesting urgent action from all Human Rights Defenders and Organizations to take appropriate steps against the Turkish Government’s unlawfulness.

Open letter to president of the European Court of Human Rights Robert Spano from Mehmet Altan

Mehmet Altan is the son of Cetin Altan* and brother to Ahmet Altan**. All three suffer from undemocratic acts of leaders of their time. His brother Ahmet Altan is still in prison. He worked as an academician at Istanbul University and was dismissed with an emergency decree law from the university; and spent nearly two years behind bars. He wrote an open letter to Robert Spano to the president of the European Court of Human Rights (ECtHR). Spano prepares to arrive in Turkey for a visit this week and receive an honorary doctor degree from the university, which Altan was dismissed.

 

Here is his letter to Spano:

My open letter to Robert Spano, the president of the European Court of Human Rights*** 

Dear President,

There are more than sixty thousand individual applications that have been lodged from Turkey to the European Court of Human Rights. Turkey ranks second after Russia when it comes to violations of rights.

As you know, I am one of the citizens of the Republic of Turkey whose constitutional rights were disregarded. I said as you know because my application was reviewed by the 2nd Section, which at the time was under your presidency.

On 20 March 2018, the 2nd Section of the ECtHR, presided over by you, set a precedent in universal law and ruled that my right to personal liberty and security and my freedom of expression had been violated. Turkey was convicted.

I thank you and the Court you now preside over for this judgment. Law prevailed.

Dear president,

Your judgment concerning me has a place in ECtHR’s history:

Ergin Ergül, who was appointed on behalf of Turkey to that case and was the only judge dissenting, put forward such arguments that you wrote “a dissenting vote” against a dissenting vote, for the first time in the history of ECtHR, if I am not mistaken. And the other members followed you.

It was announced that on September 3 2020 you will be visiting Turkey as the Minister of Justice’s guest.

But what took me aback was to find out that you will be receiving an honorary doctorate from Istanbul University.

I am reminding of the detail above exactly for this reason, to give information on the state of “the judiciary” and “law education.”

I wonder if you keep in mind that Ergin Ergül, against whom, in the name of universal law you found yourself having to cast a dissenting opinion, is a graduate of Istanbul University which will be awarding you an honorary doctorate?

Your secretariat certainly must have informed you that Istanbul University had given an honorary doctorate of law to Kenan Evren too.

Dear President,

I taught for 30 years at Istanbul University, where you will be receiving a “honorary law doctorate.” And I became a professor there 27 years ago.

I heard on television that I had been dismissed from the university through a statutory decree on 29 October 2016, while I was in my cell in prison, a month after I was detained as a result of the violation of three articles of the constitution. The people who will be giving you an honorary doctorate are the very people who dismissed me and many other academics.

I was not released despite the Constitutional Court’s judgment finding violations of three separate constitutional rights and ordering my release. To top it off, right afterwards I was sentenced to aggravated life in prison. Even after the judgment by the ECtHR, presided over by you, held that there had been a violation of my rights, the 2nd Criminal Chamber of the Istanbul Regional Court of Justice upheld my conviction. I mean to say that the event of such judicial scandals is not unusual.

Ultimately however, on 4 November 2019, I was acquitted and my acquittal became final after the Court of Cassation ruled for my acquittal.

But my ongoing case concerning my dismissal from the university is still waiting to be taken up by the Ankara 21st Administrative Court. In that case, the accused is Istanbul University, where you will be receiving your honorary doctorate.

Despite being acquitted, despite the judgments by the Constitutional Court and the ECtHR, I have not been able to return to my university where you will be receiving an honorary doctorate.

The university from which you will be receiving your doctorate, is “the accused institution” in the trials brought by many academics who were dismissed through a statutory decree as I was.

These proceedings are ongoing and it is likely that they will also be brought before the ECHR that you preside over. But in the meantime you will have become a Judge who has received an honorary doctorate from Istanbul University. I’m not sure how gratifying it would be to become a honorary member of a university, which has unjustly kicked out and forced into unemployment and poverty hundreds of academics.

Under normal circumstances, of course it would be pleasing to hear that you will be visiting Turkey. Unfortunately that’s not the case.

Dear President,

The ECtHR, under your presidency, guarantees protection of the freedoms and rights enshrined in the European Convention on Human Rights.

We want to believe that ECtHR of which you are the president secures the rights of everyone under its jurisdiction.

It is hard to say that our faith always remains intact.

The very section of the Court that you presided had given priority status to the application of Ahmet Altan, whose novels have been published in 23 countries, and who, even despite the Covid-19 pandemic has remained behind bars in Silivri Prison for the past four years. Even though the court is very much familiar with the file’s content, unfortunately we have been waiting for that priority to come into effect for the past four years.

And of course we are very much aware of the efforts being made to prevent the review of Ahmet Altan’s application and to ensure that no definitive judgment finding rights violations is made when it is taken up. But just as this is not the appropriate place to discuss this, I rather not comment on this further.

Indisputably, you are free to make your own choices. And it is clear that every one of your choices will reflect onto future decisions and bring forth new consequences.

I would like to extend an early welcome to Turkey, where you will be visiting as the President of an international high court, built upon a convention, to which victims of the judiciary have high hopes attached.

15 JULI 2016 VERMEENDE COUPPOGING PERSBERICHT

Op 15 juli 2016 vond er een verraderlijk geplande, theatrale couppoging plaats in Turkije. Als gevolg van deze
couppoging heeft de bevolking een staat van rechteloosheid ondergaan. Door middel van willekeurige wetgeving
is er besloten om mensen van hun werk te ontslaan, om werkvergunningen in te nemen, paspoorten en diploma’s
te annuleren. Daarnaast was er sprake van massa-arrestaties waarbij mensen gevangen werden genomen en
gemarteld. Als gevolg van deze zware martelingen zijn er mensen overleden en er zijn zelfs gevallen van
zelfmoord. In de overvolle gevangenissen wordt er nog steeds onmenselijk gedrag vertoond. Door de
mensenrechtenschendingen in Turkije zijn mensen genoodzaakt om hun land te ontvluchten. Tijdens deze vlucht
hebben velen hun levens of hun kinderen verloren in de Egeïsche zee en de Maritsa rivier.
Wij willen als Broken Chalk Platform de aandacht vestigen op de pijn en leed veroorzaakt door de machtsdrang
van Erdogan, waarbij hij geen oppositie dult en elke pad bewandelt om er voor te zorgen dat andersdenkenden
van de kaart verdwijnenen.
Erdogan-regime heeft met het bloedige drama dat op 15 juli 2016 werd uitgevoerd, democratie, de universele
mensenrechten, de rechtsstaat, het wegkijken van vrijheid en rechtvaardigheid, Turkije geabstraheerd van de
wereld en het land als een dictatuur willen besturen. Ze verhogen de dosering van haatdragende taal tegen de
mensen die het mozaïek van de samenleving vormen in verschillende talen, religies, rassen en gedachten binnen
het land. Ze gebruiken allerlei middelen, middelen en media van de staat om de harmonie, eenheid, integriteit en
broederschap in de samenleving uit elkaar te halen en de onevenredige macht te behouden. In plaats van
rekening te houden met de belangen van het land en de mensen, kiezen ze voor hun eigen belangen. Voor de
voortzetting van het regime heeft het allerlei soorten onwettigheid ondertekend om de Koerden, alevieten,
liberale opvattingen en de Hizmet-beweging onder hun controle te houden. Aan de andere kant gebruikt het de
volledige mogelijkheden van de staat en hun instanties en voert het een lynchcampagne tegen de beweging en
diensten in Turkije en overal in de wereld.
Het Erdogan-regime heeft vele succesvolle mensen van het openbaar ambt verwijderd door wetsbesluiten
(wetsbesluit). Het aantal mensen dat uit een openbaar ambt is verwijderd is meer dan 126.000. Tienduizenden
succesvolle mensen die hun land succesvol dienden zoals artsen, ingenieurs, aanklagers, rechters, advocaten,
diplomaten, wetenschappers, geestelijken, schrijvers, kunstenaars, politici, industriëlen, atleten, academici,
leraren, studenten en de samenleving uit alle lagen van de samenleving kregen geen recht op leven.
15 universiteiten, 1065 middelbare scholen, middelbare scholen en basisscholen, 980 klaslokalen en 848
studentenslaapzalen, die werden geopend onder de bestaande wetten en die daardoor werden gecontroleerd,
zijn gesloten met de wetsbesluiten. Meer dan 35.000 leraren en 30.000 assistent-medewerkers die in deze
onderwijsinstellingen die zijn gesloten werkten, zijn werkloos geworden. Er is een groot grote groep van
werklozen gevormd doordat deze onderwijswerkers niet meer in een particuliere of staatsinstelling meer mogen
werken. De onderwijsinstellingen die zijn gesloten en alle bezittingen van de voormalige medewerkers van de
instellingen zijn in beslag genomen. Bovendien zijn deze mensen en hun families benadeeld doordat hen geen
sociale rechten wordt verleend. EKASEN en AKTİFSEN werden gesloten.
Vrijwel alle docenten van de gesloten onderwijsinstellingen werden onderzocht voor lidmaatschap van een
terroristische organisatie. De gedetineerden werden onderworpen aan alleen in een cel, langdurige detentie en
onrechtmatige procedures. Deze praktijken zijn vernederend en destructief voor het vernietigen van hun reputatie
in de gemeenschap. Tevens werden de slachtoffers onderworpen aan foltering en mishandeling en werden 40-50
mensen gedwongen om in gevangenissen van 12 personen te verblijven. Deze behandelingen zijn een misdaad
tegen de menselijkheid en een schending van de mensenrechten.
Volgens de gegevens van het ministerie van Binnenlandse Zaken opende het regime van Erdogan een gerechtelijk
onderzoek tegen 511.000 mensen met als gevolg onwettige en fascistische druk, en werden meer dan 125.000
mensen vastgehouden uit lidmaatschap van een terroristische organisatie. Momenteel zitten er meer dan 31.000
gevangenen in gevangenissen. Gevangenissen In Turkije hebben nu rond 11.000 vrouwelijke gevangenen, en
groeien 780 baby’s op in de gevangenis samen met de moeder.
Veel mensen zijn ontvoerd door inlichtingendiensten in Turkije en in het buitenland en zijn zwaar gefolterd.
Sommige van deze mensen worden nog steeds vermist. Bovendien worden gevangenen met een ernstige ziekte
niet behandeld en worden ze achtergelaten om te sterven. Veel kankerpatiënten mogen niet goed behandeld
worden door een verbod die is uitgevaardigd door de staat om te reizen uit Turkije, met de dood tot gevolg.
Met de gemene theater coup van 15 juli en de haatdragende taal van het Erdogan-regime, de beklemmende,
polariserende en separatieve benadering, is de eenheid en solidariteit in het land verslechterd. Het vertrouwen
van mensen tegen elkaar en de staat is verloren gegaan. Onschuldige mensen wier paspoorten in beslag werden
genomen en uit het buitenland werden geweerd, moesten hun huizen verlaten en naar Europese landen migreren
in de hoop op een vrij en democratisch leven via illegale wegen. Veel mensen kwamen ook om het leven op de
wegen.
Deze vervolgingen in Turkije, de onwettigheid van het regime vragen wij de Verenigde Naties, het Europees Hof
voor de rechten van de mens van de Europese Unie voor parlementsleden, mediaorganisaties en alle volkeren, om
niet te zwijgen over de dictatoriale houding en we willen dat ze hun verantwoordelijkheden nakomen. Wij zijn
ervan overtuigd dat de rechtsstaat alleen kan worden bereikt door menselijke solidariteit.
Als BrokenChalk-platform wachten we vol hoop en geduld op de dag waarop elke wetteloosheid die van 15 juli
2016 tot vandaag is gedaan, zal worden berecht door eerlijke rechtbanken en de echte criminelen zullen worden
gevonden en gestraft. We zullen samen met slachtoffers en onschuldige mensen onze stem laten horen tegen alle
onrechtplegers.

Conférence de presse sur le soi-disant coup d’État du 15 juillet 2016

À la date du 15 juillet 2016, s’est joué perfidement en Turquie un coup d’état militaire théâtralisé. A la suite de cette tentative de coup d’état, toute la communauté turque a été victime d’injustice. Par des décrets-loi, nombreux citoyens turques se sont fait limogés, congédiés, ont vu leur passeport et diplômes suspendus, des arrestations groupés ont eu lieu et de nombreuses personnes se sont fait incarcérées et gravement torturées en prison. Ces tortures ont eu pour conséquences nombreux décès et suicides. Les conditions inhumaines d’incarcération comprenant la mise en cellule non réglementaire, la surpopulation, le manque d’hygiène et de soins sont maintenus aujourd’hui encore. Les victimes des violations des droits de l’homme en Turquie ont du quitté leur pays pour trouver refuge ailleurs. Lors de la traversée de l’Égée et de l’Evros, certains ont perdu leur vie ou celle de leurs enfants en fuyant la pression et les menaces qu’ils subissaient en Turquie.

En temps que Platforme Broken Chalk, nous tenons à retenir l’attention sur les injustices causées en Turquie et dans le monde par l’obstination du régime d’Erdoğan à déclarer licite tous les moyens pour faire taire les opposants et faire disparaître toute personne ne se ralliant pas à sa pensée.

En mettant en scène cette pièce de théâtre sanglante, en se détournant de la démocratie, des droits humains universels, de la primauté du droit, de la liberté et de la justice, en isolant la Turquie du reste du monde, en terrorisant l’innocent peuple anatolien, le régime d’Erdoğan a fini par constitué une menace pour toute l’humanité. Ses propos haineux contre les minorités constituant la diversité de la société par leurs différentes langues, religions, ethnies et pensées ne cesse d’augmenter. Ce régime se sert démesurément de tout les moyens, forces et ressources de l’État ainsi que des médias afin de détruire l’harmonie, l’union, l’intégrité et la fraternité de la société. Il fait primer ses intérêts sur ceux du pays et du peuple au lieu de faire le contraire. Au nom de la perpétuité du régime, il entreprend toute sorte d’injustice pour contrôler les Kurdes, les Alévis, les visions libérales et le mouvement Hizmet. Par ailleurs, il tente de lyncher le mouvement Hizmet en Turquie et dans le reste du monde en se servant de tous les moyens de l’État et des établissements privées.

Par des décrets-loi, le régime d’Erdoğan a radié de brillants employés expérimentés dans toute les branches de la fonction publique. Le nombre de personne s’étant fait radié de la fonction publique dépasse maintenant le seuil de 126000. Il a également refusé le droit de vie à de brillants médecins, ingénieurs, procureurs, juges, avocats, diplomates, scientifiques, théologiens, écrivains, artistes, politiciens, professionnel de l’industrie, sportifs, académiciens, enseignants, étudiants et à des dizaines de milliers de personnes instruites ayant contribué au développement et à la notoriété du pays en travaillant sérieusement dans leur branches respectives.

15 universités, 1065 lycées, collèges et primaires, 980 centre d’accompagnement scolaires 848 internats ouverts en vertus des lois en vigueur et tenues conforme à tout type d’audit ont été subitement fermés par des décrets-loi. Plus de 35 000 enseignants et 30 000 assistants travaillant dans ces établissements d’enseignement fermés se sont retrouvés sans emploi. Les travailleurs de l’éducation issus de ces établissements subirent une discrimination si forte qu’il ne leur était plus possible de travailler dans une institution privée ou publique, ainsi s’est constituée une grande communauté de chômeurs. Les établissements d’enseignement fermés ainsi que tous les biens des anciens employés de l’établissement ont été confisqués. De plus, ces personnes et leurs familles ont été condamnées à une mort sociale en étant privé de tout droit social. Le syndicat des employeurs des métiers de l’éducation (EKASEN), le syndicat Pak de l’éducation et le syndicats des enseignants actifs (AKTIFSEN) ont été fermés.

Une enquête sur l’appartenance à une organisation terroriste est ouverte pour la quasi totalité des enseignants issus de ces établissements fermés. Les personnes placées en garde à vue ont été soumis à l’isolation en cellule, à la détention prolongée et à des procès illégaux. Ces pratiques sont humiliantes en elles-même et visent à détruire leur réputation aux yeux de tous. En outre, les victimes ont été soumises à la torture et à des mauvais traitements, 40 à 50 personnes ont été contraintes à rester dans des compartiment prévus pour 12 personnes. Ces traitements sont un crime contre l’humanité et une violation des droits de l’homme.

Selon les données du ministère de l’Intérieur, le régime Erdogan a ouvert une enquête criminelle contre 511 000 personnes à la suite de pressions illégales et fascistes, et plus de 125 000 personnes ont été arrêtées pour appartenance à une organisation terroriste. À l’heure actuelle, plus de 31000 détenus se trouvent incarcérées dans les prisons turques. Tandis qu’il ya 11000 femmes détenues dans les prisons turques, 780 bébés sont en train de grandir en prison auprès de leur mère sans même avoir pu vivre leur enfance librement.

Nombreuses personnes ont été enlevées par les services de renseignement en Turquie et à l’étranger et soumises à de graves tortures. Pour certains d’entre eux, nous n’avons toujours pas eu de nouvelles. De plus, les détenus gravement malades ne sont pas traités et abandonnés à leur sort. De nombreux patients atteints de cancer sont condamnés à mort par l’État qui ne leur autorise pas de quitter le pays pour suivre un traitement

 

Avec la perfide mise en scène théâtralisé du coup d’État du 15 juillet, le discours de haine, l’approche oppressive polarisante et séparatrice du régime d’Erdogan, l’unité et la solidarité dans le pays se sont détériorés. Les gens ont perdu leur confiance en l’État et leurs concitoyens. Les innocents dont les passeports ont été confisqués et interdits de séjour à l’étranger ont dû quitter par des routes illégales leur domicile, leur patrie et leur foyer et migrer vers les pays européens dans l’espoir d’une vie libre et démocratique et beaucoup ont perdu leur vie sur ces routes.

 

Nous attendons des Nations Unies, de la Cour Européenne des Droits de l’Homme, des parlementaires de l’Union Européenne, des médias et de tous les peuples qu’ils ne gardent pas le silence et s’acquittent de leurs responsabilités face aux persécutions qui ont lieu en Turquie, l’injustice du régime Erdogan, son attitude dictatoriale et les injustices provoquées. Nous sommes fermement convaincus que l’état de droit ne sera atteint que grâce à la solidarité humaine

En tant que Broken Chalk Platform, nous attendons avec patience et espoir le jour où les vrais criminels seront trouvés et punis devant des tribunaux équitables de toutes les illégalités commises depuis le 15 juillet 2016 jusqu’à nos jours. ПРЕСС-РЕЛИЗ О ТАК НАЗЫВАЕМОМ ПЕРЕВОРОТЕ 15 ИЮЛЯ 2016 ГОДА

15 июля 2016 года в Турции была проведена коварно спланированная и театрально инсценированная попытка военного переворота. В результате попытки переворота от беззакония пострадали все слои общества. На основании произвольных Законодательных декретов (KHK) люди были уволены с работы, были аннулированы разрешения на работу, паспорта и дипломы, произведены массовые задержания, аресты, в тюрьмах люди были подвержены жестоким пыткам. В результате жестоких пыток последовали многочисленные случаи смертей и самоубийств. В переполненных тюрьмах и одиночных камерах, в антисанитарных условиях продолжается бесчеловечное обращение. Люди были вынуждены покинуть страну из-за нарушений прав человека в Турции. Спасаясь от давления и угроз, в водах Эгейского моря и реки Марицы гибли люди и их дети.

От имени платформы Broken Chalk мы хотим привлечь внимание к случаям притеснения в Турции и в мире в связи с жаждой власти со стороны режима Эрдогана, его желанием заставить замолчать оппозицию и использованием любых средств для уничтожения инакомыслящих из всех слоев общества.

Режим Эрдогана посредством инсценированного 15 июля 2016 года кровавого театрального представления, отвернувшись от демократии, всеобщих прав человека, верховенства закона, свободы и правосудия, отстранил Турцию от остального мира, посредством терроризирования невинного народа Анатолии, создал угрозу для человечества всего мира. С каждым днем внутри страны возрастает доза его ненавистнических высказываний в отношении различных слоев населения, составляющих мозаику общества, говорящих на других языках, исповедующих другую религию, принадлежащих к другим расам и имеющих иное мнение. Он использует любые государственные возможности, ресурсы, СМИ, чтобы разобщить существующую в обществе гармонию, единство, целостность и братство, и непропорционально использует полученную власть. Вместо того, чтобы задумываться об интересах своей страны и народа, он думает только о своих собственных интересах. Для продолжения своего режима, и чтобы держать под контролем курдов, алевитов, либералов и движение Хизмет, он одобрил всевозможные противозаконные меры. С другой стороны, используя все возможности государства и частных учреждений, он проводит кампанию линчевания в отношении движения Хизмет в Турции и в мире.

Режим Эрдогана на основании Законодательных декретов (KHK) отстранил с государственных должностей опытных и успешных сотрудников из каждой профессиональной группы. Число людей, уволенных с государственных должностей, составило более 126 000 человек. Он лишил права на жизнь десятки тысяч образованных людей из всех слоев общества, внесших большой вклад в развитие страны в своих сферах деятельности, заслуживших уважение успешных врачей, инженеров, прокуроров, судей, адвокатов, дипломатов, ученых, религиозных деятелей, писателей, деятелей искусства, политиков, промышленников, спортсменов, академиков, преподавателей и студентов.

На основании Законодательных декретов были закрыты 15 университетов, 1065 лицеев, средних и начальных школ, 980 учреждений дополнительного образования, 848 студенческих общежитий, открытых в соответствии с действующими законами и прошедших все необходимые проверки. Более 35 000 преподавателей и 30 000 сотрудников, работавших в этих закрытых образовательных учреждениях, остались без работы. Образовалась огромная армия безработных в связи с тем, что оставшиеся без работы работники образовательной сферы оказались в условиях невозможности трудоустройства ни в одно частное или государственное учреждение. Было конфисковано все имущество у закрытых образовательных учреждений и бывших сотрудников учреждений. Кроме того, эти люди и их семьи были приговорены к социальной смерти, запретив им пользоваться какими-либо социальными правами. Были закрыты профсоюзы: Синдикат развития работодателей в сфере образования (EKASEN), Синдикат работников образования и Объединения активных работников образования (AKTİFSEN).

Почти все преподаватели закрытых учебных заведений были допрошены на предмет их принадлежности к террористической организации. Задержанные содержались в одиночной камере, подвергались длительному содержанию под стражей и незаконным судебным процессам. Применение таких методов является ничем иным как унизительным наказанием, направленным на уничтожение их репутации в обществе, кроме того, жертвы подвергались пыткам и жестокому обращению, и в тюремных камерах, рассчитанных на 12 человек, содержалось по 40-50 человек. Такое обращение является преступлением против человечности и нарушением прав человека.

По данным Министерства внутренних дел в результате незаконного и фашистского давления со стороны режима Эрдогана было начато уголовное расследование в отношении 511 000 человек, более 125 000 человек были задержаны за «членство в террористической организации». На сегодняшний день в тюрьмах содержится более 31 000 заключенных. В тюрьмах Турции содержится более 11.000 женщин-заключенных, а 780 младенцев лишены детства и растут в тюрьмах вместе с матерями.

Большое число людей было похищено спецслужбами как в Турции, так и за ее пределами, и подвержено жестоким пыткам. О судьбе некоторых из этих людей до сих пор ничего не известно. Кроме того, заключенным с тяжелыми заболеваниями отказывают в лечении, оставляя их на верную смерть. Многим больным в Турции, страдающим от онкологических заболеваний, был наложен запрет на выезд из страны, им не позволили получить лечение, тем самым от действий государства они скончались.

После коварного театрализованного переворота 15 июля и в результате ненавистнических высказываний со стороны режима Эрдогана, посредством гнетущего, поляризующего и разделяющего подхода в стране было подорвано единство и солидарность. Утрачено доверие людей по отношению друг к другу и к государству. Невинные люди, чьи паспорта были конфискованы и был наложен запрет на выезд из страны, были вынуждены покинуть свои дома, свою родину и нелегальными путями мигрировать в европейские страны в надежде на свободную и демократическую жизнь. Многие люди погибли на этом пути.

Призываем Организацию Объединенных Наций, Европейский суд по правам человека, парламентариев Европейского союза, органы СМИ и все народы не хранить молчание относительно происходящих в Турции случаев преследования, а также относительно беззакония со стороны режима Эрдогана, его диктаторской позиции и пострадавших от него жертв, и в этой связи выполнить свои обязательства. Мы твердо верим, что верховенство закона будет обеспечено только посредством человеческой солидарности.

От имени платформы Broken Chalk мы с надеждой и терпением ожидаем того дня, когда все противоправные деяния, имевшие место с 15 июля 2016 года и до настоящего времени, предстанут перед справедливым судом, и будут найдены и наказаны настоящие преступники. Мы и впредь будем голосом всего беззакония и несправедливости вместе с пострадавшими и невинными людьми.

15. JULI 2016 INSZENIERTER PUTSCHVERSUCH PRESSEMITTEILUNG

Am 15. Juli 2016 wurde ein bösartig geplanter Putschversuch vorgespielt. Infolge des Putschversuchs spürte die ganze Gesellschaft rechtswidriges Vorgehen. Mit willkürlichen Dekreten wurden Menschen aus ihrer Arbeit entlassen, ihre Arbeitserlaubnis, Pässe und Abschlüsse wurden annulliert. Es wurden Massenverhaftungen vorgenommen und in Gefängnissen schwer gefoltert. Infolge dieser schweren Folter gab es viele Todesfälle und Selbstmorde. Viele Gefängnisse wurden überfüllt und viele unrechtmäßig verhaftete Verdächtige wurden in Einzelzellen gesetzt. Somit mussten viele aufgrund von Menschenrechtsverletzungen das Land verlassen. Die Flucht über die Ägäis und dem Fluss Mariza kostete leider vielen Menschen insbesondere Frauen und Kindern das Leben.

Erdogans Gier nach Macht, das Ziel Oppositionelle zum Schweigen zu bringen und der Wunsch alle Kontrollmechanismen in einer Person zu zusammenfassen führte zu massiven Unterdrückungen sowohl über die gesamte Gesellschaft als auch über Minderheitsgruppen.  Als Borken Chalk Plattform möchten wir weltweit alle Menschen auf die Folgen und Auswirkungen des Erdogan Regimes aufmerksam machen.

Mit dem am 15. Juli 2016 inszenierten Putschversuch, wandte sich das Erdogan Regime von der Demokratie, den Menschenrechten, der Rechtsstaatlichkeit, der Freiheit und Gerechtigkeit ab. Somit isolierte er die Türkei auf internationaler Ebene. Täglich erhöht das Erdogan Regime die Dosierung von Hassreden gegen die Menschen, die das Mosaik der Gesellschaft in verschiedenen Sprachen, Religionen, Rassen und Gedanken innerhalb des Landes bilden. Sie nutzt alle Möglichkeiten des Staates und der Medien um die Harmonie, Einheit, Integrität und den Zusammenhalt in der Gesellschaft zu brechen. Statt die Interessen des Landes und der Menschen zu berücksichtigen, folgt er seinen eigenen Interessen. Um sein Regime am Leben halten zu können, kontrolliert bzw. unterdrückt Erdogan alle oppositionelle Ansichten insbesondere die, der Kurden, der Aleviten, der Liberalen und der Hizmet-Bewegung. Beispielsweise wurde und wird zur Hizmet-Bewegung über alle Wege sowohl auf nationaler als auch internationaler Ebene eine Lynchkampagne geführt.

Per Gesetzesdeskrete wurden mehr als 126.000 Menschen in allen Berufsfeldern aus öffentlichen Ämtern entlassen. Zehntausende Ärzten, Ingenieuren, Staatsanwälten, Richtern, Anwälten, Diplomaten, Wissenschaftlern, Geistlichen, Schriftstellern, Künstlern, Politikern, Geschäftsleuten, Sportlern, Akademikern, Lehrern, Studenten und den gebildeten Menschen aus allen Schichten der Gesellschaft wurde das Recht auf Freiheit und Leben entzogen.

15 Universitäten, 1065 Gymnasien, weiterführende Schulen und Grundschulen, 980 Klassenzimmer, 848 Studentenwohnheime, die nach den geltenden Gesetzen geprüft und eröffnet wurden, wurden mit den Gesetzesverordnungen geschlossen. Mehr als 35.000 Lehrer und 30.000 Angestellte, die in diesen Bildungseinrichtungen arbeiteten, wurden entlassen. Somit hat sich eine Masse an Arbeitlosen gebildet. Jeder Einzelne wurde aufgrund der Gesetztesdekrete abgestempelt und konnte dadurch keine Beschäftigung mehr aufnehmen. Das gesamte Vermögen der entlassenen Mitarbeiter wurde beschlagnahmt. Darüber hinaus wurden diese Personen und ihre Familien zum sozialen Tod verurteilt, weil sie keine sozialen Rechte genießen durften. Gewerkschaften wie zur Entwicklung der Arbeitgeber im Bildungswesen (EKASEN), die Gewerkschaft der Bildung PAK und die Gewerkschaften der aktiven Pädagogen (AKTİFSEN) wurden geschlossen.

Zu fast allen Lehrern der geschlossenen Bildungseinrichtungen wurden die Mitgliedschaft in einer Terrororganisation untersucht. Die Inhaftierten wurden Einzelzellen, Langzeithaft und rechtswidrigen Gerichtsverfahren unterzogen. Diese Praktiken sind demütigend und zerstörerisch, wobei das Ziel war ihren Ruf in der Gesellschaft zu zerstören. Außerdem wurden die Opfer gefoltert und misshandelt. Beispielsweise wurden Gefängniszellen, die normalerweise für 12 Personen geplant waren, mit 40-50 Personen besetzt. Diese Behandlungen sind ein Verbrechen gegen die Würde des Menschen und verletzt die Menschenrechte.

 

Nach Angaben des türkischen Innenministeriums leitete das Erdogan-Regime aufgrund von rechtswidrigem und faschistischem Druck eine gerichtliche Untersuchung gegen 511.000 Menschen ein, und mehr als 125.000 Menschen wurden aus der Mitgliedschaft in einer terroristischen Vereinigung festgenommen. Bis heute befinden sich mehr als 31.000 dieser Personen in Gefängnissen. Davon bilden rund 11.000 Frauen und 780 Babys und Kinder einen deutlichen Anteil.

Viele Menschen wurden von den Geheimdiensten der Türkei sowohl im Inland als auch im Ausland entführt und schwerer Folter ausgesetzt. Einige werden sogar aktuell vermisst. Darüber hinaus wurden Insassen mit schweren Krankheiten absichtlich nicht behandelt und medizinisch gefoltert. Beispielsweise wurden vielen Krebspatienten eine Ausreisesperre verhängt. Dadurch mussten viele kranke Menschen sterben.

Mit dem inszenierten Putschversuch und der unterdrückenden, polarisierenden, diskriminierenden Haltung des Erdogan-Regimes hat sich die Einheit und die Solidarität im Land verschlechtert. Das Vertrauen der Menschen gegeneinander und gegenüber dem Staat ist verloren gegangen. Unschuldige Menschen, deren Pässe beschlagnahmt und ein Ausreisesperre verhängt wurden, mussten das Land verlassen. Sie mussten in Hoffnung auf ein freies und demokratisches Leben in europäische Länder flüchten. Dabei kamen leider viele Menschen ums Leben.

Die Vereinten Nationen, den Europäischen Menschenrechtsgerichtshof, die Europäische Union, die Politiker, alle Medienorganisationen und allen Völkern, bitten wir deshalb auf die in der Türkei stattfindende Verfolgung, die diktatorische Haltung, die Diskriminierung und Unterdrückung des Erdogan-Regimes, und auf deren Folgen und Auswirkungen hinzusehen und Verantwortung zu übernehmen. Wir sind fest davon überzeugt, dass Rechtsstaatlichkeit nur durch gemeinsame Solidarität erreicht werden kann.

Als Broken Chalk Platform hoffen wir mit Geduld auf den Tag, an dem alle Verantwortlichen für die Rechtswidrigkeiten, die seit dem 15. Juli 2016 entstanden sind, vor fairen Gerichten verurteilt werden. Wir werden weiterhin die Stimme aller Ungerechtigkeiten und unschuldigen Menschen sein, und mit den Opfern zusammenhalten.

Friedman’ın Dünya Düzdür adlı kitabından aktardığı bu Afrika sözü bize; ister aslan olalım isterse ceylan, güneş doğduğunda koşmak zorunda olduğumuzu anlatır. Hem de dünden daha hızlı. Böyle bir ortamda ayakta kalabilmek, hayatı devam ettirebilmek ise, yeni doğan güneşle birlikte oluşan şartlara uymak ve kapıya çalan fırsatları değerlendirmekle mümkün olacaktır.

 

Fırsatlar doğduğunda, çekingenlik ve ürkekliğin tehlikesinden sıyrılmak cesaretle üzerlerine atlamak hiç şüphesiz hazır olmayı gerektirir.

Hızlı tempoda seyreden iş, kariyer ve hayat akışı zaman zaman değişik sebeplere bağlı olarak yavaşlayabilir, kesintilere maruz kalabilir veya durabilir. Buna sosyoekonomik faktörler veya küçük bir virüs sebep olabileceği gibi yerine göre bir hastalık, bazen de bir haksızlık ve hukuksuzluk yol açabilir. Bu sebeplerin kaynağı kişinin kendisi veya kendi dışındaki etkenler de olabilir.

 

Ancak, her gecenin de bir sabahı olduğu unutulmamalı, güneş doğduğunda daha hızlı koşmaya başlayabilmek için bu dönemde oluşan bol vakit ve imkan iyi değerlendirilmelidir. Rutinin bozulması ile oluşan belirsizlik girdabına yakalanmamak önemlidir. O zamanların verimli kılınması, güneşle beraber koşmak için gerekecek enerjinin biriktirilmesi, o donanımın kazanılması, en çok insanın kendi kendini motive ve disipline etmesine bağlıdır. Başarının özünde insanın kendi gayret ve katkısının yattığı göz ardı edilmemelidir.

 

Yaşamakta olduğumuz şu Covid-19 sürecinde hemen hemen dünyanın her yerinde, yediden yetmişe herkes evine kapanmak zorunda kaldı. Dışarıya çıkamadı. Bazı insanlar bu dönemde bile iyi bir planlama ile kendilerini, işlerini ve mesleklerini geliştirici çalışmalara devam ederken bazıları ise boşa geçirdi. Halbuki öyle yada böyle bu izolasyon sürecinin bir sonunun olduğunu öngörüp akabindeki yoğun rekabet ortamında başarılı olabilmek için kendimizi geliştirici ve güçlendirici çalışmaları gerçekleştirmek en akıllıcası olacaktır.

Bu hazırlık kişinin kendi özel durumlarına göre farklılıklar gösterecek, özellikle geçmiş eğitimleri, iş ve meslek hayatı en belirleyici faktörler olacaktır. Press Release: Stop abducting people illegally.

Fatih Keskin, the Turkish citizen, and director of Richmond Park Bihac College, who has been carrying on his education and training activities in Bihac in Bosnia and Herzegovina for 15 years, was first summoned to Una-Sana Canton Police Station and then taken to the Immigration Center and taken into custody.

Fatih Keskin, who could not be explained why he was arrested even by the arrestors, was subjected to maltreatment in a cold environment without heating in severe winter conditions. It is against international human rights to be subjected to maltreatment that is not worthy of human dignity.

We know that hundreds of Turkish citizens that are members of the Hizmet movement have been abducted and tortured after July 15, 2016 by Erdogan regime both in Turkey and abroad. Educator Fatih Keskin, who worked in Bosnia and Herzegovina for 15 years, is also demanded to be subjected to abduction by the Turkish government’s witch hunt with similar procedures as other abductions. We hope that the administration and the judiciary of Bosnia and Herzegovina will not be the object of the Erdogan regime.

As International Broken Chalk Association, we invite Bosnia and Herzegovina’s administration and judiciary to comply with its own constitutions and international law, and we demand that Fatih Keskin be released as soon as possible.

We also hope that the United Nations Human Rights Commission, the European Court of Human Rights, and other organizations and human rights defenders will be the followers of the unlawfulness suffered by Fatih Keskin and will make the necessary initiatives.

Ahmet Burhan Atac: The Story of the Child Who Got Killed Collectively*

From September 24, 2018, when he was diagnosed with cancer until May 7, 2020, when he died, the story of two years of resistance, suffering, and persecution.

Ahmed Burhan Atac, the children of Zekiye-Harun Reha Ataç, was diagnosed with bone cancer on September 24, 2018. When he was diagnosed, his father was under arrest. Ahmet’s 2-year struggle for his life reflects Turkey’s recent grim years.

On February 20, 2018, while Ahmet was playing games with his friends in the nursery school. His mother, Zekiye Atac, his father Harun Reha Atac, and his little sister were taken to the police station. Ahmet was only six years old. Mrs. Atac, who was laid off during the state of emergency, was detained for 14 days. She was released after being detained for another 2.5 months. Mr. Atac was banned from teaching with a statutory decree. After being arrested for 13 days, he was arrested on charges of being a member of a terrorist organization. One of the reason was, he was a director in a private dormitory which was affiliated with the Gulen movement. The period Ahmet has been without his parents for three months coincides with the onset of his cancer.

Harun Reha Atac, who was on trial at the Adana 2nd High Criminal Court, was sentenced to 9 years and nine months in prison. Two months after his son was diagnosed with cancer. On November 30, 2018, according to the medical reports, Ahmet was diagnosed with cancer and started chemotherapy, were submitted to the 2nd High Criminal Court of Adana, and a legal request was made regarding Mr. Atac’s release pending trial until the Supreme Court decision. Adana 2nd High Criminal Court President ruled on Harun Reha Atac’s detention by saying, “I have no remission whatsoever for you.”

Ahmet was taken to treatment at Cukurova University Hospital. When he did not recover with chemotherapy and radiotherapy, he had an operation in July 2019, and the tumor in his shoulder blade was cleaned. However, during controls performed in September 2019, it was determined that cancer spread to his lung.

Mother Zekiye Atac said, “We had an interim evaluation this week. A tumor of 4 cm. in size was detected in the lung. Doctors were also shocked to see such growth and spread in such a short time. I am helpless. My son is dying before my eyes. ” Following the mother’s comments and Ahmet’s emotional video in which he wished his father was by his side, the story of Ahmet attracted attention on social media.

LET HIM BEAT CANCER WITH HIS FATHER

A campaign was launched on social media for Ahmet’s father to be tried without arrest and to be with his son during the treatment process.

Mother Zekiye Atac said, “We had a phone call in the morning with his father in prison, but Ahmet did not want to talk to his father on the phone. Because he couldn’t stand it, but then he asked me, “What did my father say?”. Please, Lord, let him come on his own, not on the phone.” Thousands of social media users showed support with hashtags like “Let Him Beat Cancer With His Father,” and Ahmet’s story got recognized on a national level.

AHMET’S MOTHER GOT DETAINED

While the sharp criticism over the court order against Mr. Atac’s release continued, Mrs. Zekiye Atac was detained for the second time on October 15, 2019. Ahmet was left without a father and a mother. Zekiye Atac was accused of being a ‘member of the terrorist organization’ because she accepted the donations for the treatment of his son, said Mrs. Atac’s relatives. Zekiye Atac was released on bail the next day, after public outrage regarding her detention.

A HOPE OF TREATMENT ABROAD

As Ahmet’s disease progressed, his doctors directed the family to Germany, saying that he could be treated at the Immuno-Oncology Center in Cologne, Germany. Upon contacting the clinic, it was stated that Ahmet could be processed, provided that he is transferred promptly. The family did not have the economic power to cover the expenses. Only after it was announced that a business person would cover the costs of the first stage of the treatment, Ahmet flew to Germany on January 20, 2020. Mrs. Atac could not accompany his son because of her overseas travel ban. Gülsüm Atac, Ahmet’s 70-year-old grandmother, accompanied him.

 

FUNDRAISING IN 24 HOURS

Human Rights Defender Arlet Natali Avazyan, who closely followed Ahmet’s case, stepped in and started a charity campaign on Twitter on January 24, 2020, for treatment expenses. The required 50 thousand euros was raised within 24 hours.

 

MRS. ATAC EXPRESSES GRATITUDE

Mother Atac stated that raising the money necessary for the treatment under 24 hours was very moving. She added: “I would like to thank Mrs. Natali and all those contributed for their financial and moral support. Now I believe more firmly that my son will be treated. I think he will recover and be with us again. “

He was saying that her husband, who is in prison, is pleased that Ahmet went to Germany for treatment. Mrs. Atac added, “I will inform him that the money needed for treatment is raised during our phone call tomorrow. He will be pleased with that. Because all he thinks about is his son”.

APPEAL AGAINST THE OVERSEAS TRAVEL BAN

Mother Atac intensified her attempts to lift the overseas travel ban and to get a passport. However, the prosecution did not raise the ban.

But Ahmet, apart from his mother in Germany, was always crying. His mood was very poor, and therefore he did not respond to the treatment at the desired level. Mete Atakul, a businessman who hosted Ahmet at his home in Germany, said that Ahmet did not even eat properly because of his grief.

TRIPLE TRAVEL BAN

Thanks to intense public pressure, Zekiye Atac’s ban on overseas travel was lifted by court order in February 2020. However, upon the objection made by the prosecutor’s office, the court re-imposed the ban for the second time.

After Mrs. Atac’s failed attempt to meet Ahmet in Germany, Ahmet returned to Turkey to see his mother on February 8, during the two-week break of his treatment.

As a result of the attempts made by Natali Avazyan and HDP MP Ömer Faruk Gergerlioğlu, Mrs. Atac’s ban on overseas travel was lifted again on February 21, 2020. The German Embassy quickly issued a visa to Mrs. Atac.

On March 2, 2020, Zekiye Atac was stopped once again while flying to Germany from Istanbul Airport with Ahmet. Mother Atac learned at the airport that this time, the 7th High Criminal Court of Mersin issued a travel ban for the third time.

“YOU ARE KILLING MY SON COLLECTIVELY”

Zekiye Atac posted a video on her social media account with the note “You are killing my son collectively”: “We are in Istanbul now. We flew from Adana to Istanbul this morning for our connecting flight to Cologne. Still, unfortunately, the police confiscated my passport. Passport and visas had been issued, but unfortunately, they re-imposed the ban the next day. Ahmet should be in Cologne tomorrow. He needs to catch up with his treatment. His condition is not well. Please, I want this dilemma resolved!”

AHMET FLIES TO GERMANY WITH HIS MOTHER

Ahmet and his mother stayed at the airport to solve the problem. Public outrage sparked over social media. Singer and philanthropist Haluk Levent announced that he had talked to Minister of Interior Süleyman Soylu. The next day, on March 3, 2020, the travel ban was lifted again, and Ahmet flew to Cologne with his mother.

IT WAS TOO LATE

Time lost because of judicial processes worsened Ahmet’s health. He had many fractures in his leg bones, his blood test values decreased, and he did not respond to treatment.

Doctors in Cologne stated that Ahmet’s blood values ​​were critically low and that his body could not bear the treatment, and it was too late.

Ahmet and his mother moved back to Turkey on March 11, 2020.

Mother Atac said that the doctors informed her that Ahmet’s blood values ​​have fallen too low since the first treatment. He should gather strength to continue the second stage of the procedure.

PHONE CALL BETWEEN FATHER AND SON

A campaign was held for the father to be tried without arrest. On March 27, 2020, the record of a telephone conversation between Ahmet and his father was published.

During the conversation, Ahmet wants his father to ‘come.’ He cries: “Come here now. I can’t stand it anymore.” His father, Harun Atac, replies: “My son, I can’t come. I want to go as well, but I can’t, son. They don’t let me out, my baby. “

A MEETING OF 5 HOURS

After the massive effect of the record, the same day prosecutor’s office allowed Mr. Atac to meet Ahmet for 5 hours for the first time. For a 5-hour meeting, father Harun Atac came to the hospital where Ahmet was.

INTENSIVE CARE: FATHER NOT ALLOWED

Ahmet’s condition worsened every day, and eventually, he was taken into intensive care on May 6, 2020. Doctors put Ahmet to sleep.

Permission was asked from the prosecutor’s office for the father Harun Reha Atac, who was detained in Tarsus Prison to see Ahmet for the last time. Those who accompany the family said that Harun Atac was not allowed to be with his son on that night when Ahmet was in intensive care, but only the following day.

SUCCUMBED TO CANCER

At the end of his battle against the bone cancer he was diagnosed with under the conditions of ’emergency state,’ Ahmet had three heart failures. During the early hours of May 7, 2020, Ahmet passed away…
